Introduction

PRIVATE OCEAN SOCIETY by BAJA MOANA ("POS") is a private membership-based ocean lifestyle club operating in Los Cabos, Baja California Sur, Mexico. By accessing this website, requesting information, applying for membership, making reservations, or participating in any activity organized by POS, users agree to the following general terms and conditions.

Private Club Nature

PRIVATE OCEAN SOCIETY is a private club and not a public charter company. Memberships and experiences are limited, subject to availability, operational conditions, weather, maritime regulations, and approval by the Operator. Submission of an application or inquiry does not guarantee acceptance into the club.

Risk Assumption

Ocean and maritime activities involve inherent risks, including but not limited to weather conditions, ocean conditions, equipment failure, injury, illness, or accidents. All participants voluntarily assume these risks. The Operator, vessel owners, captains, crew, affiliates, and partners shall not be held liable for personal injury, loss, delays, cancellations, or damages arising from participation in any activity.

Member Conduct

Members and guests are responsible for complying with all safety instructions, operational rules, and onboard conduct requirements. Unsafe behavior, intoxication, misconduct, or violations of club policies may result in:

Payments & Refunds

Membership fees, maintenance fees, reservations, and additional services may require advance payment and are generally non-refundable unless otherwise stated in writing. Prices may be listed in U.S. Dollars and converted to Mexican Pesos using the applicable exchange rate at the time of payment. Applicable taxes may apply.

Third-Party Providers

PRIVATE OCEAN SOCIETY may collaborate with third-party providers such as villas, chefs, transportation companies, photographers, or concierge services. The Operator is not responsible for acts or omissions caused by independent third parties.

Intellectual Property

All content, branding, logos, photographs, videos, and materials published by PRIVATE OCEAN SOCIETY by BAJA MOANA are protected intellectual property and may not be reproduced or used without prior written authorization.

Governing Law

These Terms & Conditions shall be governed under the laws of the United Mexican States and the State of Baja California Sur. The Operator reserves the right to modify these Terms & Conditions at any time without prior notice.
